1. Acceptance

Agreement to These Terms

These Terms & Conditions (“Terms”) apply to your access to usedtrucktoppersales.com and purchases from Used Truck Topper Sales. By using the website, creating an account, submitting an order or otherwise using the services, you agree to these Terms and the policies incorporated by reference.

If you do not agree, do not use the website or place an order. You must be at least 18 years old and legally capable of entering a purchase agreement.

2. Accounts

Customer Information and Account Security

You agree to provide current, accurate and complete information during checkout and when creating or using an account. You are responsible for maintaining the confidentiality of login credentials and for activity performed through your account.

Notify us promptly if you suspect unauthorized access, payment activity or misuse. We may suspend or restrict an account when reasonably necessary to protect customers, investigate fraud, enforce these Terms or comply with law.

3. Product Listings

Condition, Photographs and Availability

We make reasonable efforts to describe each product accurately, including brand, model, condition, color, features, measurements and known fitment information. New and used items are identified on their product pages. Used products may show normal wear, marks, fading, repaired areas or other condition details visible or described in the listing.

Photographs are part of the listing, but screen settings, lighting and camera conditions may affect color appearance. A color name or photograph does not guarantee an exact paint match. Confirm a paint code when an exact match is important.

Inventory may be unique or limited to one unit. A product placed in a cart is not reserved until the order is accepted. If an item becomes unavailable before acceptance, we will cancel the affected order and refund any captured payment rather than substitute another product without permission.

Brand transparency: Brand names and vehicle trademarks are used only to identify products or compatibility. Unless a product page expressly states otherwise, these references do not claim sponsorship, certification, affiliation or endorsement by the referenced manufacturer.

4. Vehicle Fitment

Confirm Compatibility Before Purchasing

The vehicle filter and fitment information are shopping aids. Compatibility may depend on the exact make, model, model year, generation, cab configuration, bed length, body shape, bed accessories and previous vehicle modifications.

Before ordering, compare every listing detail with the truck and verify physical measurements when necessary. If you request fitment help, provide complete and accurate vehicle information. Written guidance based on inaccurate or incomplete customer information cannot ensure compatibility.

Fitment-related returns: When the listing accurately states compatibility and the wrong truck details were selected or supplied, the return is treated as a non-defective return under the Refund and Returns Policy.

5. Orders

Order Submission and Acceptance

Submitting an order is an offer to purchase the selected products. An automated confirmation acknowledges receipt but does not by itself guarantee acceptance, inventory or shipment. We accept the order when we confirm fulfillment, release the product to a carrier or confirm pickup availability.

We may reasonably decline or cancel an order because of inventory unavailability, an obvious pricing or listing error, payment failure, suspected fraud, shipping limitations, prohibited activity or inability to verify required information. If payment was captured for a canceled order, it will be refunded to the original payment method.

Order quantities may be limited when necessary to protect inventory availability or prevent unauthorized resale and abuse.

6. Pricing and Payment

Prices, Taxes and Authorization

Website prices are displayed in Canadian dollars (CAD) unless expressly stated otherwise. Applicable taxes, shipping and approved freight services are shown separately before the order is finalized when required.

You authorize the selected payment provider to charge the total amount clearly disclosed during checkout. Where an order requires a separately quoted freight service, any additional shipping amount will be disclosed to you and requires your approval before fulfillment

If an obvious pricing error is discovered before acceptance, we may cancel and refund the order or ask whether you want to proceed at the correct disclosed price. We will not charge a corrected price without your approval.

7. Shipping and Delivery

Delivery Terms

Shipping destinations, costs, handling times, transit estimates, freight procedures and damage-inspection instructions are described in the Shipping & Delivery Policy, which is incorporated into these Terms.

Delivery dates are estimates unless a specific guaranteed service is expressly purchased. The customer must provide an accurate, accessible delivery address and be prepared to receive and safely unload an oversized shipment when required.

8. Returns and Refunds

Return Eligibility

Eligible Canada orders may be returned within 30 days after delivery under the conditions in the Refund and Returns Policy. That policy explains return conditions, authorization, shipping responsibility, inspection and refund timing and is incorporated into these Terms.

Do not install, drill, paint, modify or damage a product that you may need to return. Contact us before shipping any item back so we can confirm eligibility and provide the correct destination and carrier instructions.

9. Installation and Use

Safe Mounting and Operation

Truck toppers and accessories must be installed using appropriate hardware and methods for the vehicle and product. Professional installation is recommended when the customer lacks the tools, instructions or experience required for safe mounting, wiring, sealing or load management.

The customer or installer is responsible for inspecting mounting points, clamps, wiring, seals, racks and fasteners before use and periodically afterward. Do not exceed product, rack, roof or vehicle load limits. Used Truck Topper Sales is not responsible for damage caused by improper installation, unauthorized modification, overloading, misuse or failure to maintain mounting hardware, except where liability cannot legally be excluded.

10. Warranties

Product-Specific Coverage

Any warranty applies only when it is expressly stated on the product page or in documentation provided with the product. A manufacturer warranty, when available, is administered under that manufacturer’s terms and may require registration, proof of purchase or direct contact with the manufacturer.

Used products are sold in the condition described and photographed. To the maximum extent permitted by law, we disclaim warranties not expressly provided, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms excludes a warranty or consumer right that applicable law does not allow to be excluded.

11. Acceptable Use

Prohibited Website Activity

You may not use the website to:

Violate law, another person’s rights or these Terms.

Submit false account, payment, order, review or vehicle information.

Interfere with security, scrape the website at harmful scale, introduce malware or attempt unauthorized access.

Use website content, photographs or product data to impersonate the store, mislead customers or create unauthorized listings.

12. Intellectual Property

Website Content and Trademarks

The website’s original design, text, arrangement, store branding, graphics and other original content are owned by or licensed to Used Truck Topper Sales and are protected by applicable intellectual-property laws. You may use the website for personal shopping and order-related purposes but may not reproduce or commercially exploit protected content without permission.

Third-party product names, logos and vehicle trademarks belong to their respective owners. Their appearance is for product identification and compatibility reference and does not transfer ownership or imply affiliation.

13. Reviews and Submissions

Customer Content

If you submit a review, photograph, question or other content, you confirm that it is accurate to your knowledge, that you have the right to submit it and that it does not violate another person’s rights. You grant us a non-exclusive, worldwide, royalty-free license to display, reproduce and adapt that content for store, support and promotional purposes, subject to the Privacy Policy.

We may decline or remove content that is unlawful, deceptive, abusive, irrelevant, contains personal payment information or violates these Terms. We do not require a positive review as a condition of support.

14. Third-Party Services

External Providers and Links

The website may use or link to third-party payment, carrier, analytics, advertising, map, social or other services. Their separate terms and privacy notices govern their services. A link does not necessarily mean that we endorse or control the third-party website.

15. Disclaimers and Liability

Limits Permitted by Law

We work to keep the website available and accurate but do not promise uninterrupted access or that every error will be corrected immediately. Website content is provided for general shopping information and does not replace inspection, measurement, professional installation guidance or vehicle-manufacturer instructions.

To the maximum extent permitted by law, Used Truck Topper Sales will not be liable for indirect, incidental, special, exemplary or consequential losses arising from website use, delayed delivery, improper installation, misuse or unauthorized modification. For a claim arising directly from a purchased product, our aggregate liability will not exceed the amount paid for the product giving rise to the claim, except where applicable law requires otherwise.

Nothing in these Terms excludes liability for fraud, intentional misconduct, personal injury caused by negligence, or any obligation or consumer remedy that cannot lawfully be limited.

16. Events Beyond Control

Service Interruptions and Delays

We are not responsible for delay or failure caused by events beyond reasonable control, including severe weather, fire, flood, labor disruption, carrier or freight interruption, government action, network outage, supply interruption or similar event. We will make reasonable efforts to communicate material delays and complete or refund affected orders as appropriate.

17. Disputes and Applicable Law

Resolving Concerns

Please contact us first so we can attempt to resolve an order or service concern promptly. These Terms are governed by the laws that lawfully apply to the transaction and to Used Truck Topper Sales, without excluding mandatory consumer protections.

If a dispute cannot be resolved informally, either party may pursue available remedies in a court or forum with lawful jurisdiction. These Terms do not require mandatory arbitration or waive rights that cannot lawfully be waived.

18. General Terms

Changes, Severability and Entire Agreement

We may update these Terms to reflect changes in the store, services or legal requirements. Updated Terms will be posted at this URL with a revised effective date. Changes apply prospectively unless applicable law requires otherwise.

If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. These Terms, the order confirmation and the linked policies form the agreement regarding website use and purchases, unless a separate written agreement signed by an authorized representative applies.
